BUFFALO, N.Y. -  Animal Cruelty Investigators have charged a man in connection with a YouTube video showing a dog being abused on Chandler Street in Black Rock last week.

The SPCA of Erie County identifies the person arrested as David Roman, 31, who has no permanent address and had been staying with friends in Buffalo and Elma.

The arrest occured on Monday around 1:30 p.m. at the corner of Amherst and Bridgeman Streets, when Roman was apprehended by SPCA officers accompanied by Buffalo Police.

Roman is charged with one count of misdemeanor animal cruelty, according to SPCA Spokewoman Gina Browning. Browning also says Roman did not own the dog.

The SPCA was notified about the YouTube video on Saturday around noon. The video shows a man walking the dog down the street, only to kick and punch it.  According to the SPCA the incident occurred late Friday night. 

By 5 p.m. Saturday, SPCA police had tracked down the dog and had taken it into custody for treatment.

Browning says the person who shot the video was sought out through "various forms of social media" and when contacted agreed to turn over his tape as evidence.

The video has since been removed from YouTube.

"Somebody was aware that this was happening and didn't just stand by and watch or get in the car and leave. They decided to do something about it and to take video and intervene in this way so the SPCA could do something about it," Browning told 2 On Your Side.

"She (the dog) did have some lameness and she was very sore generally on her body, so she has suffered from several traumas," said Helene Chevalier DVM, who treated the dog.

However, the injuries sustained by the dog were not serious enough to rise to the level of Roman being charged with a felony.
