BATAVIA, NY - The woman found guilty of hitting an elderly Walmart employee last year will not be going to jail for now.
A State Supreme Court judge from the 4th Appellate Division has issued a stay in the sentence of Jacquetta Simmons pending her appeal.
Simmons was sentenced to five years in prison for hitting 70-year-old Grace Suozzi on Christmas Eve last year.
Simmons was convicted under the state's "Granny Law," which gives stiffer penalties for an assault on someone 65 or older.
According to The Batavian, Simmons still has to post bail before she can be released.
