HAMBURG, N.Y. -- Over the past 36 hours, Hamburg Attorney James Tresmond's phone has been ringing off the hook from New Yorkers who want to join his lawsuit against the state regarding the new gun control measures signed Tuesday by Governor Cuomo.
Tresmond says the law goes too far in restricting gun rights, and so far, more than 10,000 people have either called or emailed him asking to be part of the lawsuit.
He said he expects to take 3 to 4 weeks to research the topic and write out the lawsuit, which will likely be filed in federal court. He's working with a half dozen other attorneys from other parts of the state.
"I just want the people to know that we're promoting the rights, the constitutional rights of the people on the side of wanting to keep their lawful firearms," Tresmond said.
Tresmond is looking closely at the 5th Amendment of the U.S. Constitution, which says a person shall not "be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation."
Tresmond asked, "Can the government take what rightfully belongs to somebody without due process and without just compensation?"
