BUFFALO, NY - An appellate court has upheld the conviction of a Town of Tonawanda man found guilty of killing his mother in 2009.

David Heck, 58, was found guilty of murdering his mother Ruth in their Conant Drive home.

Heck tried to get the conviction overturned, claiming that the evidence was insufficient and that police violated his rights.

The appellate panel rejected Heck's argument stating that after Heck beat his mother in the head with a hammer, he "staged the crime scene to make it appear that his mother had fallen and hit her head."
