BUFFALO, NY - James Caldwell, 7, was one of two children buried alive in North Carolina. The biological parents of the boy live in Buffalo and want to remember him during a vigil this week.

The boy's uncle was operating a backhoe in a pit last week when the walls caved in on the children.

Caldwell's parents say the boy, his twin sister and 9-year old brother were adopted by their maternal grandparents. Jeanette Harris, the biological mother told 2 On Your Side that she gave up custody because of a mental health condition. However, it has not stopped her from grieving the death of her child."I hugged his casket, I didn't care how stupid it looked, I loved my baby," she said.

Caldwell died along with his cousin when a wall of dirt collapsed on them in a hole in Lincoln County, North Carolina, near Charlotte.

The Harris family is planning a vigil at Martin Luther King Park in Buffalo, Wednesday, 5 p.m. If it rains, it will be re-scheduled.

The vigil is important to Leon Harris, "it's he only way I can express and get the grief off my heart," he said.

Jordan Arwood, the boy's uncle and father of the six-year-old girl Chloe Jade Arwood, who died is charged with possession of a gun by a felon, and making a controlled substance. He's being held on $20,000 bond.
