AMHERST, N.Y. - John Pieri entered Amherst Town Court Thursday afternoon as someone on probation.

He left it in handcuffs after a judge found that he had repeatedly violated his probation, and sentenced Pieri to the maximum, a year in jail.

Almost exactly four years ago, Pieri was a passenger in his then-girlfriend's Angela Glinski's SUV when Glinski, who had been drinking, hit two Daemen College students on Main Street.

The crash left one of the girls Amy Stewart -- a star soccer player -- in a coma for two months with a traumatic brain injury and serious physical injuries.

Pieri encouraged his girlfriend to drive away from the scene, and for that he received 30 days in jail and three years probation.

The conditions of his probation including not drinking or leaving Erie County.

Well Pieri did both, he was seen a number of times at Artpark in Niagara County drinking at concerts.

Even after he was warned by his probation officer, Pieri continued to drink and violate his probation.

In court on Thursday, Pieri's attorney argued for leniency saying that Pieri had a learning disability and that if Pieri was sent to jail he would lost his job and car.

As Pieri's attorney was speaking, Amy Stewart was sitting in court crying.

"Where he's going to lose a job, lose a house, well those are things he can eventually get back, how about the things that I can never get back for the rest of my life?" she said.

Scott Brown: "What was taken away from you?"

Amy Stewart: "I would like to be playing soccer again that was a big part of my life, and I went for an alternate route in my educational career because of what I was going for originally was getting to difficult for me to handle, and the job choice and things like that."

With great determination Amy went back to school after getting out of the hospital and graduated. She's now a teacher's assistant.

And just two weeks ago, something else happened in Amy Stewart's life - she got engaged.

Her fiancee has told her that he'll protect her no matter what.
