BUFFALO, NY-- A judge has refused the request by attorneys for Beth Hoskins to dismiss the animal abuse case against her, because of alleged prosecutorial misconduct.
Her lawyers claimed the Assistant District Attorney in the case had a romantic relationship with an SPCA employee during part of the non-jury trial.
The judge says he didn't see a conflict since that employee was not a witness in the case.
He is expected to announce his verdict in a few weeks.
The SPCA seized dozens of horses from Hoskins' farm back in 2010.
