DA Withdraws Motion to Reinstate Charges in Barnaby Case

BUFFALO, NY - District Attorney Frank Sedita tells 2 On Your Side he has withdrawn a motion to reinstate charges against Matthew Barnaby in a previous domestic incident.

Back in May, Barnaby was arrested for a domestic disturbance after trying to break into his estranged wife's home.

Those charges were to be dismissed if he stayed out of a trouble for a year, something Barnaby did not do when he was arrested for DWI in December.

However, following a conversation with Barnaby and his wife and Barnaby taking responsibility for his actions, DA Frank Sedita withdrew the motion.

Barnaby pled guilty as charged to a number of DWI counts and thanked the D.A. "for holding my feet to the fire and making me fully accountable," for his actions and Barnaby said he was entering an in-patient treatment program for a drinking problem.

"I've never seen it before where the defendant has thanked the D.A. for fully prosecuting him," said Sedita.

Sedita says there's a certain irony in Barnaby's role as an agitator with the Sabres and his current problems.

D.A. Frank Sedita: "He made his mark in the NHL by being overly aggressive and it occurs to me that the same kind of conduct that brought the fans to their feet at the hockey rink is also the same kind of conduct that can bring a citizen to their knees in civil society. And Mr. Barnaby, to his credit is taking steps to address that and I wish him nothing but the best in that regard."
