Brant Man Arrested for DWI in North Collins Rollover

NORTH COLLINS, N.Y. - Erie County Sheriff's have arrested a Town of Brant man for Felony DWI following a rollover accident early Christmas morning.

Deputies say the rollover happened shortly after 9 a.m. Tuesday on Seneca Road near Mile Block Road.

Police say they arrived to the crash scene and located 29-year-old James Nelms, who was unharmed and the only person inside the vehicle.

Deputies determined Nelms was intoxicated and learned he also had a revoked driving privilege, as well as a prior DWI conviction.

Police say Nelms was arrested and charged with Felony DWI, Felony Aggravated Unlicensed Operation of a Motor Vehicle, Circumventing an Interlock Device, and failure to keep right.

Investigators added that Nelms had taken the vehicle belonging to his grandmother without her permission, and was also charged with unauthorized use of a motor vehicle in the third degree.

Police say Nelms refused a chemical breath test and was taken to the Erie County Holding Center pending arraignment in the town of North Collins Court.
