Dems in Disputed 63rd State Senate Primary in Court

BUFFALO, N.Y. (AP) - Lawyers for two Democrats in a close New York state Senate primary race are headed back to court.
Incumbent Timothy Kennedy last week claimed victory in the Buffalo-area 63rd District, but challenger Betty Jean Grant isn't conceding.
Grant wants a court-ordered review of affidavit ballots that were ruled invalid by the Board of Elections. The two sides will appear before state Supreme Court Justice Joseph Glownia today.
The candidates were 91 votes apart on primary day, but Kennedy's lead widened to 186 votes following a count of absentee and other outstanding ballots.
The Erie County Board of Elections said last week that with all votes counted, the unofficial tally gave Kennedy 11,456 votes to Grant's 11,270.
