BUFFALO, N.Y. -- NOCO has filed a counter lawsuit against the Niagara County family who lost a child and home in an explosion.

The countersuit is in response to a lawsuit filed by the Johnson family in October against NOCO for negligence and wrongful death in the horrible house explosion last July.

NOCO was the family's propane supplier at the time of the explosion.

The explosion, which investigators ruled was caused by some type of propane leak, destroyed the Johnson home and sent debris flying up and down their street. The blast killed 14 year-old Sarah Johnson, and badly injured her sister, Katie.

NOCO alleges in the complaint that the homeowner, Jody Johnson disconnected the NOCO propane tank and connected another propane tank without the knowledge or consent of NOCO.


A statement was issued by Matthew J. Beck, Esq., an attorney representing the Johnson Family:

"We are aware of the third-party complaint filed by NOCO against Jody Johnson and a propane fill station. The allegations against Jody Johnson are denied. These allegations ignore that Mr. Johnson never would have hooked up a temporary tank if NOCO had issued a warning or properly treated the situation as an emergency upon the Johnsons' report of a smell of gas in the house, rather than treating the circumstances as a mere empty tank situation. NOCO is simply attempting to deflect blame for this horrific incident."
