A parking ticket from the City of Buffalo upset an Amherst resident who recently contacted our 2 On Your Side Tipline.

Arthur MacDonald says he had to recently appear in Buffalo City Court at 9:15 AM for a business matter. MacDonald says he and his wife are disabled so that is why they have the specially designated plates for their car. MacDonald say they did find a space set aside for the disabled on Delaware Avenue across from the City Court Building and put the required coins in the blue meter.

But when they returned a short time later they found a $35 dollar city ticket on their windshield. The citation referenced a nearby sign which states "No Standing between 7 AM and 10 AM" on weekdays.

MacDonald is questioning why the city would include the 9 to 10 AM hour when they must realize that court proceedings could take place at that hour. He also questioned the height of the signs.

Buffalo Parking Commissioner Kevin Helfer says the MacDonalds could take their case to an administrative law judge who may be sympathetic. Helfer also says there are spaces for the disabled set aside in nearby parking ramps.

MacDonald says their physical conditions do not allow them to walk the distances which he says might be required in a parking garage. He says past experience forced them to park on the roof level with difficult access.

City spokesman Mike DeGeorge says the signs for no standing reflect the traffic flow through the area during the morning rush hour. He says the hours extended to 10 AM may also be in effect because of certain winter weather conditions.
