Mohamud Found Guilty of Murder in the Second Degree

BUFFALO, NY - After about three hours of deliberation, the jury in the trial of Ali Mohamad Mohamud found him guilty of murder in the second degree for the brutal killing of his 10-year-old stepson.

The jury rejected the defense team's argument that Mohamud's "extreme emotional disturbance" had blinded him to the consequences of his actions and that it was never his intention to kill the boy.

After an hour and 15 minutes of deliberating, the jury asked the judge for evidence to review. They requested the signed statement Mohamud had made to Buffalo Police Detective Sergeant James Lonergan and a copy of the jury instructions.

They also asked for a copy of the medical examiner's report.  However, the judge told them the ME's report was never put into evidence, so they could not review it.  They could review testimony given by the medical examiner during the trial.

The closing statement for the defense took about half-an-hour Thursday morning. Attorney for the defense Kevin Spitler tried to make the case that, "Mr. Mohamud lost the ability to comprehend the natural results of his actions." 

The prosecution wrapped up its case in about 50 minutes. Erie County Assistant District Attorney argued that "a person who should have been [Abdi's] protector was instead his murderer," asking rhetorically, "Intent to cause death? How about intent to slaughter?"
