BUFFALO, N.Y. -- Danielle Kellogg, the 24-year-old driver accused of D.W.I. in Tuesday's crash that killed seven month old Baylee Dion, has posted $20,000 bail and is out of jail.
Multiple sources have confirmed Kellogg's release to 2 On Your Side. We're told she walked out of the Erie County Holding Center in Buffalo at around 5:45 p.m. Thursday.
Kellogg, is still scheduled for a felony hearing that is set for Friday afternoon in the Town of Brant Court. According to Steve Boyd, the civil attorney representing the family of Baylee Dion, it's unclear if Kellogg will attend or if the hearing will be waived.
Boyd says the family's focus is not really on the legal process, but rather on little Baylee and the funeral arrangements they're making for their daughter.
"As they go through this grieving process and make preparations for the memorial for this little girl, who they had so much hope for, the things that are happening in the legal background, are a lot less important for them," he said.
The crash happened on Route 20 in the Southern Erie County Village of Farnham. The baby's mother, Denise Hine, 31, was hurt in the crash, but is expected to be O.K.
Boyd says that the family is "doing the best they can and they're staying together, they're all supporting each other, Denise is still very sick and very uncomfortable from her injuries, but she's got the support and love of her family and her friends."
